End User Terms of Service

These Terms of Service ("Terms") govern your access to and use of the trading signal automation services (the "Service") provided in connection with The Pad and supported by automation infrastructure provided by Harvest Automations LLC ("Harvest").

By accessing, installing, or using the Service, you ("User") agree to be legally bound by these Terms.

If you do not agree, you must not use the Service.

1. Service Description

The Service provides:

• Automated delivery of educational trading signals derived from the trading activity of The Pad
• Infrastructure that allows Users to configure their own servers to independently receive and execute those signals
• Optional setup tools to assist Users in configuring their server environment

The Service does not include:

• Investment advice
• Account management
• Trade execution on your behalf
• Custody or access to funds

All trades are executed solely by your own infrastructure and brokerage account based on your choices.

2. Educational Use Only — No Investment Advice

You expressly acknowledge and agree that:

• All signals are provided for educational and informational purposes only
• Neither The Pad nor Harvest:
  • Is a registered investment advisor
  • Makes personalized recommendations
  • Provides financial, legal, or tax advice
• Any decision to place trades is made entirely by you

Past performance is not indicative of future results.

3. User-Owned Infrastructure

3.1 Server Responsibility

You are solely responsible for:

• Provisioning and paying for your own server (e.g., DigitalOcean VPS)
• Maintaining operating system security
• Applying updates and patches
• Configuring firewalls, ports, and credentials
• Securing API keys and private information

Harvest and The Pad do not own, manage, or control your server.

3.2 Security & Misconfiguration Disclaimer

You acknowledge and agree that:

• You are fully responsible for the security of your server
• Harvest and The Pad are not liable for:
  • Weak or reused passwords
  • Insecure SSH configurations
  • Open ports
  • Exposed API keys
  • Malware, unauthorized access, or data breaches
  • Losses resulting from misconfiguration or negligence

Any setup tools or documentation provided are offered "as-is" and do not shift security responsibility.

4. Trade Execution & Risk Acknowledgment

You acknowledge that:

• Trades are executed using your brokerage account and credentials
• Automation merely transmits signals; execution is your choice
• Trading involves substantial risk, including total loss of capital
• Slippage, latency, API failures, and brokerage outages may occur

You assume all risks associated with market activity and automation.

5. No Guarantees or Warranties

The Service is provided "AS IS" and "AS AVAILABLE."

Neither Harvest nor The Pad guarantees:

• Profitability
• Signal accuracy
• Trade execution timing
• System availability outside normal trading hours

There are no guarantees of uptime, results, or suitability.

6. Limitation of Liability

To the maximum extent permitted by law:

• Neither Harvest nor The Pad shall be liable for:
  • Trading losses
  • Lost profits
  • Indirect, incidental, or consequential damages
• Total aggregate liability shall not exceed the amount you paid for the Service during the 30 days preceding the claim.

7. Indemnification

You agree to indemnify and hold harmless Harvest Automations LLC and The Pad from any claims, damages, or liabilities arising from:

• Your trading activity
• Your server configuration or security practices
• Regulatory inquiries related to your use of the Service
• Claims from third parties resulting from your actions

8. Acceptable Use

You agree not to:

• Reverse engineer or replicate the automation system
• Attempt to access or influence systems you do not own
• Redistribute signals without permission
• Circumvent technical safeguards

Violation may result in immediate termination of access and legal action at the discretion of Harvest and The Pad.

9. Termination

Access to the Service may be terminated:

• At your discretion
• For violation of these Terms
• Upon discontinuation of the Service

Upon termination, you are responsible for disabling automation and managing your server.

10. Intellectual Property

All automation software, tooling, and system design remain the exclusive intellectual property of Harvest Automations LLC.

You are granted a limited, revocable, non-transferable license to use the Service solely for personal, lawful purposes.

11. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles.

12. Entire Agreement

These Terms constitute the entire agreement between you and the Service providers and supersede any prior representations or understandings.
